I was arrested last February with marijuana. After multiple delays and the worst lawyer (that I am also suing - the lawyer did nothing but swindle me for money) I am going to a small county jail for 40 days. I leave next Tuesday.
I will be reachable only by snail mail during February.
The ironic part is I don't do any drugs and it wasn't mine. Just wrong place wrong time when some small town cops decided to it was time to transform into super fuzz.
The jail is small. I already spent a week in it so I know what to expect and as long as I follow the rules (which I will) there wont be violence or trouble directed at me. Just lots of books, card games, donuts, kool aide, and an uncomfortable bed for 40 days. Not ideal by any means, but it isn't going to destroy me or anything.

This is shameful. In some states you can smoke for fun and in others you get locked up still. What's the charge? What state?
Too bad you're not rich so you can actually fight it and win vs the lawyer. I hate to give you bad news but your chances of winning against a lawyer is astronomically low.
Keep your spirits up and try to keep yourself busy reading or something. Maybe brainstorm new ideas for RU. Too bad you can't have access to a PC, even if it'd be offline.
I forgot the wording of the charge but it is something like intent to deliver.

It's cost about $40K including gov fees, shitty lawyer fees, and good lawyer fees. I was told if I gave the gov an additional $40K they would drop the charges.
I am not actually suing the old lawyer. I have enough info to have his license suspended for ethics violations. I have to get the bar association to tell him to make a deal with me or they take his license. Then I get a partial refund. New lawyer says that suing a lawyer would cost me hundreds of thousands of dollars but with a properly worded letter sent to the bar association I can get a big refund.

Intent to distribute I think. So they are claiming you're a drug dealer. Figures they'd wanna trump up the charges. That marijuana is ruining lives every day and stuff!
"Controlled delivery" is what they called it. I was in a car that had a lot of weed.
Most of this doesn't really apply to me, because I don't have a normal life where I care about much of this, but this is their goal for a normal person:
1. Claim someone has weed - unless you are secretly video taping the encounter - your side of the story doesn't count.
2. Charge you tens of thousands of dollars that will put nearly anyone into debt or at least severely damage their life.
3. Send them to jail - anything over two weeks and nearly any person is going to lose their job.
4. Criminal record - will prevent nearly anyone from getting a decent job.
5. Send you to a place that is ruled by gangs, by design, and has zero goal in making you a better person. Instead you will just grow closer to the criminal world.
6. Take away your constitutional right to vote.
7. Take away your constitutional right to bear arms.
8. If you are given parole then you lose your constitutional right against unlawful searches and seizures until parole is over. This was a threat they made to me but wont happen.
9. They also threatened to send me to a Chicago jail where I would be rapped and stabbed. A sheriff actually said that to me. I am going to a more friendly jail where that doesn't happen.
10. They legally have to provide you with a "nutritional diet". I didn't think they were doing that so I asked. The entire definition of nutritional is quote "2,000 calories per day". 75% of those calories are donuts and kool-aide. So you will probably come out fat, sick and diabetic.
So because someone had weed, they lose their job, ability to find a new job, are broke and severely in debt, lose constitutional rights and just spent time in criminal college. How is this supposed to benefit society.
During the week I was in I got appendicitis. Probably unrelated but I wonder if this hadn't happened would I still have lost my appendix.
They also took my computer which is something that caused a delay in RU, some cash, my phone, and a few other things. I asked if I could have them back. They said they had no record of any of it.
They also design it so you have almost no choice but to make a deal. If I had gone to court my lawyer would have been substantially more expensive. If I was found not guilty I would just walk away. But if I was found guilty, instead of 40 days in an easy jail I would get 6-15 years a hard Chicago jail. To me that means a fair trial was not an option. And on top of all that you have to deal with lawyers who suck just as much as everyone else involved in all this.

I'm amazed, literally, that they could pin you with intent to sell. My theory though unproven, is that if you and all involved say literally nothing from the point of arrest its very difficult to prove intent to sell; it does take a lot of evidence, more so **if you actually aren't some big drug dealer!** but that's probably because of that lawyer you were talking about. If you could prove negligence on his part or whatever you could probably get a mistrial or w/e, but then again it is only 40 days, not like you're doing years because of it. the laws anywhere, if they can pin some sort of intent to sell, are crazy harsh. Here in CT its mandatory 3 years or some fine iirc. Ridiculous for sure. Im sure the repercussions from the felony will do much more harm than the actual time you serve.

I didn't actually read your last post, depending on how much you were caught with and where a lot of what I say is stupid. lol
if it was a ton of it you might be better off taking their crap 'deal' to extort and kidnap you for a lil bit, but otherwise they can literally say anything they want to you, and a lot of the time you'd probably just get off easy. why take their word for it you know. the laws in CT are split for these things as over and under 1kg, like 2lbs. I'd definitely drag it through court if it was under that bar or whatever you'd call it.

I'm not going to be able to prove he hurt my case - he did way more to help than a court appointed attorney would. I can prove ethics violations that just effect what I paid him, not my case. He did at one point have a "private" conversation with me about what kind of deal I would accept while he allowed the prosecutor to secretly stand behind me and ease drop. That's when I fired him and he charged me a $3k firing fee on top of all the other double charging he had already been doing. But I won't be able to prove that. My word against theirs.
My suggestion for anyone else that ever finds themselves in a similar situation. Video tape everything, always.
Mandatory sentence only happen if you don't take a deal. My mandatory was 6-15 years. That is if you lose at trial.
The prosecutor also said he thought I deserved a better deal but he couldn't offer me one because he has given so many worse sentences to minorities that he would look raciest if a white guy got anything less. Supposedly my deal is still better than most in that city.

Sorry to hear Kong. I had a situation in HS where we went down to the shore and at this time i was straight-edge. We went with beer and weed in my car. Got pulled over. There were two of us. The car ahead of us the dude had marijuana or alcohol in plain sight.
The cop comes over to my car next. I didn't realize one of my buddies was drinking in the back. The cop looks into the car with his flash light, see's the kid kicking something under the seat. Cops search my car find the beer and weed. Accuse me of the weed. I pleaded with the people in my car to confess. They didn't. I said test me now. It's not mine. Nothing came of it for me. The others were a different story.

Its not about the drug its about the money. Ever take a look at the laws against distributing alcohol or tobacco?

Anything you send is technically property of the state. Example, I can use Tenser's sudoku books for forty days but when I leave, the state will keep them. So don't send sanything expensive. A few printed articles is enough.
I'm allowed card games and paper back books. I have about 7 books and I bought the game Boss Monster 2. It was cheap, $20 but after all of this, I'm kinda pissed that a prison guard will take it home when I leave.

Really sorry to here brother, ive been through it too last year, but with my own prescribed pain medication, I didn't have it in my bottle ( because I don't carry around a whole entire script like a drug dealer ) 2 pills almost got me trafficking, instead I got possession of narcotics. I told them ( Cops and the judge during court ) to call my pain management doctor to verify. They said either way I'm getting a charge, take the plea and become a convicted felon with suspended jail time of 5 years or do the 5 and still be a convicted felon...asinine!

Unfortunately, this is not a case of a simple misunderstanding. What JLD did was illegal, full stop. It's a retarded law under most circumstances, including his, but it's the law none the less. Trying to fight it would be futile and a waste of time and money.

Depends on the class of the pill. If it's a controlled substance, then yes. All depends on the class of the medication, something like heart medication or something is fine.
Everything I'm saying here is based on my brief 5 minute research session, I'd advise you look into it yourself to be certain.

Back! Now I hate the government even more. Not a single thing they do makes sense or shows any form of empathy.
I got extremely sick for 2 weeks - I think because of lack of nutrition and massive amounts of mold and dust. I got some sort of lung infection - I think it was an infection because I wasn't contagious. Fever with fever dreams and hallucinations for 5 days, coughing blood for 2 weeks, didn't crap for 8 days straight - which starts to feel the same as food poison - there was blood in my poop and my pee was rust color from swallowing so much blood from my lungs. Still recovering from that. Now I just feel exhausted but not sick.
Besides that, nothing too bad happened. Just overall pointless dumb bureaucracy. The jail was built in the 60's and hadn't been updated since then and didn't seem like it had been cleaned once either. The toilet literally would shoot water 3 feet in the air randomly once every couples hours, sitting on it was a gamble. We would have to clean toilet water off the floor, sink and table with just toilet paper. If we told the guards they would say, with pride, that the toilet is from the 60s and that it's amazing that it still works at all and it would not be fixed. There was 8 guys in the room, sharing that one toilet, in one month alone those 8 guys fines totaled hundreds of thousands of dollars. They're making so much money off of BS crimes but expect us to clean toilet water off the table we eat on with just TP.
Whole bunch of other stupid crap like, sleep on yoga mats with no pillow and a blanket that is more hole than blanket. The shower worked so poorly that it was pointless to even try using it and the shower drain smelled like raw sewage.
The food was absolutely pathetic. If they had feed it to a dog, PETA would be outside protesting until they were shut down.
Sounds like you could get your record cleared Jason. Some states have paperwork you can fill out to either get the record suppressed (hidden from public) or pardoned (erased). You have to wait a certain amount of time before you can file it.
There are also companies that claim to be able to hide your record from employers for a fee (about $200). I don't know if they are a scam or not.

First time I ever did a crossword puzzle. The answers were ripped out of the back of the books. Did you do that or the guards?
Just before I went in they said I couldn't have any books or games sent in. Which was sort of a lie. It is up to the individual guard reading your mail to decide. The rule is you can have them but half the guards are such dicks that they think it is wrong for you to have books and games so they throw them away or steal them. So some stuff would come in and some stuff would not. I brought Boss Monster with me which they didn't allow but then someone mailed me Exploding Kittens which they did allow. You are supposed to leave all books and games there but I sneaked Exploding Kittens out in my underwear. I brought a bunch of books which they didn't allow in, but they allowed the puzzle books in, after ripping out the answers.
I had a goal of coming up with one new app idea every day. I was on track until I got sick. I have about 25. Most would fall into the category of quick easy click bait ideas. Nothing to be too proud of but worth doing.
Anyways, good to be back and done with all that.

Crazy... sounds like an absolute nightmare. I get that it's not supposed to be fun, but cmon.. ripping out the answer pages from the crossword book? It's such a little thing but it says a lot about the mentality of those guards.

Nah we didn't do that. My wife was blown away when I told her. Sounds like the guards are wanna be tough guys that are restrained by the law. I imagine that kind of jail was a literal hell a few decades ago.

What a nightmare, damn. I sent a letter, and then about a week later I sent the game Pandemic. I figured someone else would send puzzle books. The only thing you missed here at RU were the dozens of submissions for Yolympics, mostly Berzerk, Hang-On, and Commando. I'm going to post a thread regarding off-site tourneys, because I had a question/idea or two. Other than that, glad you're back and in one piece. My nephew got sentenced to 2 years in medium security prison in Alabama a few years ago for meth manufacturing and distribution. It sounded a lot like the S-Hole you were stuck in. After just over a year, he'd been complaining about pneumonia symptoms for months. They finally took him to the hospital, he was diagnosed with lung cancer, and he was dead within 48 hours. Once you're inside, they don't give a shit about you. I know it's supposed to be punishment/rehab, but there's no excuse for treating people like shit and just letting them rot. Here's to hoping you never go back.

I know it's supposed to be punishment/rehabI don't think it is. I don't think they care about punishing, especially for drugs, and it's certainly nothing even remotely close to rehabilitation - closer to the exact opposite of rehabilitation. It is profit. That is the entire point. Money and Power. The only way to increase profit is to increase the number of people entering the system, decrease the number of people exiting the system, decrease the money spent on each prisoner while raising taxes spent on the entire system. Retribution, rehabilitation, morals and sense do not enter into it.
