Nah that's the Gadsden Flag. It was created during the American revolution but today it's mainly used by teabaggers who hate immigrants.

Regardless of what the confederate flag originally stood for it is now a symbol of racism. White power losers fly it alongside the swastika, the KKK flies it and it was used by people campaigning against civil rights. Here's a couple quotes from people who know about this issue-

It should be a part of history not the present. If a game is about history then great, if it's promoting that traitorous and bigoted flag then bad.
